4. (vic) any transfer in a demerger, of a capital asset, being a share or shares held in an indian company, by the demerged foreign company to the resulting foreign company, if-.

5. (ii) اس سیکشن کی دفعات، جس حد تک ممکن ہو، نتیجے میں آنے والی کمپنی پر لاگو ہوں گی، جیسا کہ ان کا اطلاق تقسیم شدہ کمپنی پر کیا جاتا، اگر تقسیم نہ ہوئی ہوتی۔

5. (ii) the provisions of this section shall, as far as may be, applied to the resulting company, as they would have applied to the demerged company, if the demerger had not taken place.

6. (i) کمپنی کی تمام جائیداد، تقسیم سے فوراً پہلے، نتیجے میں آنے والی کمپنی کے ذریعے منتقل کی گئی، تقسیم کے نتیجے میں کمپنی کی ملکیت بن جاتی ہے۔

6. (i)all the property of the undertaking, being transferred by the demerged company, immediately before the demerger, becomes the property of the resulting company by virtue of the demerger;

7. notwithstanding anything contained in any other provisions of this act, in the case of a demerger, the accumulated loss and the allowance for unabsorbed depreciation of the demerged company shall-.

8. (ii) an amount equal to 0.7 per cent, of the aggregate of the market value of the shares issued or allotted to the resulting company and the amount of consideration paid for such demerger, whichever is higher.

9. (ii) حصص کی مارکیٹ ویلیو کے 0.7% کے برابر رقم جو جاری کردہ یا نتیجے میں آنے والی کمپنی سے منسوب کی گئی ہے اور مذکورہ تقسیم کے لیے ادا کی گئی غور کی رقم، جو بھی زیادہ ہو۔

9. (ii) an amount equal to 0.7 per centum of the aggregate of the market value of the shares issued or allotted to the resulting company and the amount of consideration paid for such demerger, whichever is higher.

10. (3) جہاں نیا اثاثہ فروخت کیا جاتا ہے یا دوسری صورت میں انضمام یا تقسیم کے حصے کے طور پر اس کی تنصیب کی تاریخ سے پانچ سالوں کے اندر منتقل کیا جاتا ہے، پیراگراف (2) کی دفعات کمپنی کے ضم شدہ کمپنی یا نتیجے میں آنے والی کمپنی پر لاگو ہوں گی، جیسا کہ معاملہ ہو سکتا ہے، جیسا کہ انضمام کرنے والی کمپنی یا اسپن آف کمپنی پر لاگو ہوتا ہے۔

10. (3) where the new asset is sold or otherwise transferred in connection with the amalgamation or demerger within a period of five years from the date of its installation, the provisions of sub-section(2) shall apply to the amalgamated company or the resulting company, as the case may be, as they would have applied to the amalgamating company or the demerged company.
